Woman slips on slice of prosciutto and demands $50,000 in damages

Imagine ending up in the hospital after a pleasant visit to a restaurant. That’s what happened to an American woman from Boston. Was she poisoned? Did she injure herself with her knife and fork? Or perhaps choke on a piece of meat? No, none of the above. She slipped on a slice of prosciutto. The compensation she is seeking? $50,000, or just over €45,000.

The claim for damages is being brought against the Italian restaurant chain Eataly, which has 40 locations worldwide. Some of them are in the United States, including Boston. During the American woman’s visit, she slipped on a slice of prosciutto that was lying on the floor. This happened in the part of the restaurant where meals are served.

Physical and emotional damage

The woman broke her ankle in the accident. It must have been quite a tremendous fall—and that must have been one very slippery slice of prosciutto. The accident has left her with more than $7,500 in bills, both from the hospital and the physiotherapist. But what she considers even worse is the emotional damage caused by the fall. The accident resulted in “an impairment of her enjoyment of life and the suffering of an enormous amount of pain,” according to an article by RTL Nieuws. Well… She undoubtedly experienced pain, but this makes it sound as though she will never smile again for the rest of her life. All in all, she is demanding $42,500 for this emotional damage. So $50,000 in total.

Safe environment

The American woman also believes that Eataly should have provided a safe environment for its guests—one in which you don’t simply fall over a slice of prosciutto. She has one more demand: she wants her case to be heard by a jury. A jury of citizens would then assess the extent to which Eataly is responsible for this incident. I’m very curious to see the outcome. These days, nothing surprises me anymore when it comes to America—although some things still make me raise my eyebrows. For example, food that is banned in the country (yes, really) and how bizarrely unhealthy American school lunches are. Anyway, that’s food for other discussions.
