Ka-ching! Supermarket must pay cashier €66,000
Had she really stolen a bracelet? Or not? The cashier insisted she was innocent, and a subdistrict court ruled that her summary dismissal was indeed unjustified, meaning the supermarket chain has to pay a hefty compensation.
The 52-year-old cashier had worked at the Jumbo in Hellevoetsluis for twenty years. She was dismissed because the supermarket thought she had stolen a bracelet. The expensive bracelet, worth €269, was found in the supermarket. The cashier put the bracelet in the lost-and-found locker, but the piece of jewellery later disappeared from there. The supermarket suspected her of theft and summarily dismissed her.
Security footage
She disagreed. She challenged the decision, but a judge also ruled in favour of the supermarket. Security footage showed the employee taking something from the locker and putting it in her pocket, which could have been the bracelet. The dismissal was deemed justified, and the cashier also had to pay the supermarket €3,000. Ouch!
Insufficient evidence
The cashier insisted she was innocent and appealed. And what do you think? The subdistrict court found insufficient evidence for the summary dismissal. The video footage does not show exactly what the woman took from the locker. The supermarket must pay the employee compensation for the damage caused by the wrong decision, amounting to €66,000: two years’ salary comes to €36,000, plus additional compensation because this incident also meant she could not find another job as a cashier.
